Thanks to Child Protection Services, we’re about to find out. As is common in the US (and becomng lamentably more so in Canada), a judge will end up deciding what the laws should be. That is our common law system working. Though don’t blame the americans the british are the ones who came up with it. If we did not have it we would not have many of the parts of law that we hold dear.
